• \"You,\" \"User\" refers to the individual accessing or using the Service
• \"Garage\" or \"Service Provider\" refers to automotive service businesses listed on our platform
• \"Service Request\" refers to a request for automotive service submitted through the app
• \"Content\" refers to text, images, photos, data, and other materials uploaded to the Service

3. Description of Service

Garage88 is a platform that connects vehicle owners with nearby garages and automotive service providers. Our Service includes:

• Finding and viewing nearby garages
• Submitting service requests for vehicle maintenance and repairs
• Communicating with service providers
• Managing vehicle information
• Receiving notifications about service status

We are a platform only. We do not provide automotive services directly. All services are provided by independent third-party garages.

4. Eligibility

To use our Service, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding contracts
• Own or have authorization to service the vehicle(s) you register
• Provide accurate and complete registration information
• Comply with all applicable laws and regulations of India

By using the Service, you represent and warrant that you meet these requirements.

5. Account Registration

5.1 Account Creation

To access certain features, you must create an account by providing:

• Your full name
• Valid email address
• Phone number
• Physical address
• Password

5.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your password
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

Do not share your account credentials with anyone.

5.3 Accurate Information

You agree to:

• Provide accurate, current, and complete information
• Update your information promptly when it changes
• Not impersonate any person or entity
• Not create multiple accounts for fraudulent purposes

We reserve the right to suspend or terminate accounts with false or misleading information.

6. Use of Service

6.1 Permitted Use

You may use our Service to:

• Find automotive service providers
• Submit legitimate service requests
• Communicate with garages regarding your vehicle
• Manage your vehicle information
• Review and rate services you've received

6.2 Prohibited Conduct

You agree NOT to:

• Use the Service for any illegal purpose
• Violate any local, state, or national laws of India
• Harass, abuse, or harm service providers or other users
• Submit false or fraudulent service requests
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to the Service
• Scrape, crawl, or data mine the Service without permission
• Interfere with or disrupt the Service's operation
• Use the Service to spam or send unsolicited communications
• Reverse engineer or decompile the app
• Remove or modify any copyright or proprietary notices
• Use automated systems (bots) to access the Service
• Impersonate other users or service providers
• Post offensive, defamatory, or inappropriate content

Violation of these terms may result in immediate account termination and legal action.

7. Vehicle Information and Service Requests

7.1 Vehicle Registration

You may register vehicles you own or are authorized to service. You are responsible for:

• Providing accurate vehicle information including registration number
• Ensuring you have authority to request services for registered vehicles
• Updating vehicle information as needed
• Providing valid vehicle documentation when required

7.2 Service Requests

When you submit a service request:

• You authorize us to share your information with selected garages
• The request does not create a binding contract until confirmed by the garage
• Pricing, availability, and service terms are determined by the garage
• We are not responsible for the quality, timing, or outcome of services

7.3 Cancellations

• You may cancel service requests according to the garage's cancellation policy
• Late cancellations or no-shows may incur fees charged by the garage
• We are not responsible for cancellation fees

8. Content and Intellectual Property

8.1 Your Content

You retain ownership of content you upload (photos, documents, reviews). By uploading content, you grant us:

• A worldwide, non-exclusive, royalty-free license
• To use, store, display, and transmit your content
• For the purpose of operating and improving the Service

We may share your content with garages to fulfill service requests.

8.2 Content Guidelines

All content you upload must:

• Be relevant to automotive services
• Not violate any third-party rights
• Not contain illegal, obscene, or offensive material
• Not contain personal information of others without consent
• Be accurate and not misleading
• Comply with applicable laws

We reserve the right to remove content that violates these guidelines.

8.3 Our Intellectual Property

The Service, including its design, features, graphics, logos, and code, is owned by us and protected by copyright, trademark, and other laws. You may not:

• Copy, modify, or create derivative works
• Use our trademarks without written permission
• Distribute or sell any part of the Service

9. Location Services

Our Service requires access to your device's location to:

• Enable service at your location
• Provide accurate distance and navigation information

You may disable location services in your device settings, but this will significantly limit app functionality.

10. Third-Party Services

• Garages are independent third-party service providers
• We do not employ or control garages
• We do not guarantee the quality, safety, or legality of garage services
• Service contracts are between you and the garage
• We are not liable for any damages resulting from garage services
• Garages are solely responsible for work performed on your vehicle

10.2 Third-Party Links

The Service may contain links to third-party websites or services. We are not responsible for:

• The content or practices of third-party sites
• Any transactions you enter with third parties
• The privacy practices of third parties

11. Payments and Fees

11.1 Service Fees

• Currently, Garage88 is free to use for customers
• All service payments are made directly to the garage
• We do not currently process payments or receive service fees
• Garages set their own prices and payment terms
• Any disputes regarding payments should be resolved directly with the garage

11.2 Future Fees

We reserve the right to introduce fees for certain features in the future. We will provide 30 days advance notice of any fee changes.

12. Reviews and Ratings

12.1 Posting Reviews

You may post reviews and ratings of services you've received. Reviews must:

• Be based on your genuine experience
• Be honest and accurate
• Not contain offensive or defamatory content
• Not violate any privacy rights
• Not be posted in exchange for compensation (unless disclosed)
• Comply with applicable laws

12.2 Review Moderation

We reserve the right to:

• Remove reviews that violate our guidelines
• Investigate suspected fake or fraudulent reviews
• Disable review privileges for violations
• Remove reviews that contain false or misleading information

We do not guarantee that all reviews are accurate or authentic.

13. Privacy and Data Protection

15.2 Limitation of Liability

• Indirect, incidental, special, or consequential damages
• Loss of profits, revenue, data, or use
• Damages resulting from garage services or service providers
• Damages from unauthorized access to your account
• Damages from errors, viruses, or service interruptions
• Damage to your vehicle resulting from garage services
• Any damages exceeding the amount you paid us in the past 12 months (currently ₹0)

15.3 Garage Services

WE ARE NOT RESPONSIBLE FOR:

• The quality, safety, or legality of garage services
• The actions or omissions of service providers
• Damage to your vehicle resulting from garage services
• Disputes between you and service providers
• Accuracy of garage listings or information
• Professional qualifications or certifications of garages

You use garage services at your own risk.

16. Indemnification

You agree to indemnify, defend, and hold harmless Garage88, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another person
• Content you upload to the Service
• Your interactions with service providers
• Any damage to your vehicle claimed to result from services arranged through our platform

17. Termination

17.1 By You

You may terminate your account at any time by:

• Using the \"Delete Account\" feature in app settings
• Contacting our support team at support@garage88.in

Upon termination, your data will be deleted as described in our Privacy Policy.

17.2 By Us

We may suspend or terminate your account immediately if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• We are required to do so by law
• We discontinue the Service (with 30 days notice)
• Your account remains inactive for more than 2 years

17.3 Effect of Termination

Upon termination:

• Your right to use the Service ends immediately
• We may delete your data (subject to legal retention requirements)
• Provisions that should survive termination will remain in effect
• Outstanding service requests will be cancelled

18. Dispute Resolution

18.1 Governing Law

These Terms are governed by the laws of India without regard to conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts in [Your City/State, India].

We are not liable for delays or failures due to circumstances beyond our reasonable control (natural disasters, war, pandemics, government actions, etc.).

19.7 No Agency

No agency, partnership, or joint venture is created between you and us.

19.8 Language

In case of any conflict between the English version and any translation of these Terms, the English version shall prevail.

20. Compliance with Indian Laws

20.1 Information Technology Act

We comply with the Information Technology Act, 2000 and associated rules, including:

• Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011
• Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021

20.2 Motor Vehicles Act

Users must ensure their vehicles comply with the Motor Vehicles Act, 1988 and maintain valid:

• Vehicle registration
• Insurance coverage
• Pollution certificates (if applicable)

20.3 Consumer Protection

Your rights under the Consumer Protection Act, 2019 are not affected by these Terms.

By using Garage88, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.

If you do not agree to these Terms, you must immediately stop using the Service and uninstall the application.
