The products of the Garage 88 shall include but shall not be limited to the curated courses material designed and published by the Garage 88 and provided to you for delivering the Services to you.

No Proprietary Information may be copied, downloaded, reproduced, modified, republished, uploaded, posted, transmitted or distributed in any way without obtaining prior written permission from Garage 88, and nothing on the Platform or Services shall be or products deemed to confer a license of or any other right, interest or title to or in any of the intellectual property rights belonging to Garage 88, to you.

Garage 88 shall at all times retain full and complete title to the information, content or materials and all Proprietary Information provided by Garage 88 on any medium.

Garage 88 respects the intellectual property rights of others and expects all users to do the same. If you believe that any content on the Platform infringes your copyright, you may submit a written takedown request to Email: info@garage88.in Subject: DMCA Takedown Request – Copyright Infringement Your request must include: 1. Identification of the copyrighted work claimed to be infringed. 2. Identification of the infringing material, including URL or screenshot. 3. Your full contact details (name, address, phone, email). 4. A statement that you have a good-faith belief that the use is unauthorized. 5. A statement under penalty of perjury that the information in the notice is accurate. 6. A physical or electronic signature. Garage 88 may remove or disable access to the reported content and may terminate the accounts of repeat infringers. False claims may result in legal liability.

PAYMENT, REFUND & CANCELLATION POLICY

PAYMENT TERMS :

All payments on the Platform must be made through authorized payment gateways. Users must provide accurate billing details. Garage 88 will not be responsible for payment gateway errors or transaction failures. Taxes, charges, and processing fees may apply as per law. Service Partners may modify prices based on diagnosis or inspection. Prices displayed on App / website may vary due based on actual conditions during vehicle inspection.

REFUND POLICY :

A user may request a refund of amount paid in advance ONLY if: 1. The Service Partner has not yet accepted the booking. 2. If a Service Partner cancels a booking. 3. Garage 88 cancels the booking due to unavailability of partners. 4. A payment was deducted due to a technical/payment gateway error. Once the vehicle is picked up or service has started no refund is applicable.

CANCELLATION POLICY

If any amount paid in advance : 1. If user cancels before a Service Partner accepts the booking → 100% refund (minus convenience fees). 2. If the user cancels after acceptance but before pickup → a cancellation charge between ₹199 – ₹999 or 25% of amount paid whichever is higher may apply. 3. If pickup has occurred → No cancellation allowed.

PRICING ERRORS POLICY

Garage 88 or their Service partner, Franchise or agent reserves the right to cancel or modify bookings in case of: - Typographical errors - Incorrect service rates - Misquoted spare part prices - System or technical pricing glitches - Wrong labour estimates In such cases: - The user will be notified with the correct price - The user may accept or decline the corrected quote - If declined by user, the booking will be cancelled and a refund will be issued (if applicable) Garage 88 is not obligated to honor incorrect or erroneous prices.

DISPUTE ESCALATION RULES

Service-related disputes (work quality, part issues, delays, damages or other) are handled as follows: Step 1 — Direct resolution with Service Partner. Users must first contact the Service Partner directly. Step 2 — Garage 88 Support Coordination Garage 88 may assist in communication but is not responsible for: - Service outcome or Spare Part Issue - Compensation against delay, damages or other - Vehicle damage - Losses or third-party liabilities If unresolved, the user may pursue remedies under applicable consumer laws against the Service Partner, Franchisee or Agent directly but not on Garage 88. Garage 88 liability is strictly limited to the amount paid to Garage 88 for booking facilitation services (if any).

SERVICE BOOKINGS VS E-COMMERCE PURCHASES

Service Booking Payments The User acknowledges and agrees that all payments for vehicle servicing, repairs, diagnostics, or any workshop-related services booked through the Garage88 Platform shall be collected directly by the respective franchisee / Service Partner. Garage88 does not collect, process, or hold service payments on behalf of Franchisees. Ecommerce Product Payments Payments for products purchased through the Garage88 ecommerce store shall be collected by Garage88 through authorized payment gateways. Garage88 shall be responsible only for product-order related payment processing and refunds in accordance with this Policy. No Liability for Franchisee Service Payments Garage88 shall not be responsible for any disputes, delays, failures, or disagreements regarding service charges, invoices, refunds, or compensation claims arising between the User and the Franchisee.

ECOMMERCE RETURNS, REFUNDS AND SHIPPING POLICY

Return Window

Users may request a return of eligible products purchased through Garage88 within seven (7) days of delivery, provided the product is unused, undamaged, and in original packaging.

Defective or Damaged Products

If a product is delivered in a defective or damaged condition, the User must notify Garage88 within forty-eight (48) hours of delivery. Garage88 may provide a replacement or refund after verification.

Refund Timelines

Approved refunds shall be processed within seven (7) to ten (10) business days to the original payment method.

Shipping Obligations

Garage88 shall make reasonable efforts to ensure timely delivery. Delays caused by courier partners, force majeure, or external circumstances shall not result in additional liability beyond refund of product amount where applicable.

DIGITAL PERSONAL DATA PROTECTION ACT, 2023 COMPLIANCE

Data Fiduciary

Garage88 acts as the Data Fiduciary for personal data collected through the Platform. Personal data shall be processed only for lawful purposes including booking facilitation, ecommerce fulfillment, fraud prevention, and customer support.

User Rights

Users have the right to access, correct, withdraw consent, and request deletion of their personal data as per DPDP Act, 2023. Requests may be made via email at info@garage88.in.

Data Breach Reporting

Garage88 shall maintain reasonable security safeguards. In the event of a data breach, Garage88 shall notify users and authorities as required under applicable law.

SELLER IDENTITY DISCLOSURE (E-COMMERCE)

All products displayed and sold on the Garage88 ecommerce section are either: (a) sold directly by Garage88 Private Limited; or (b) sold by third-party sellers/franchisees whose details (name, address, GSTIN) shall be displayed on the product page. Garage88 acts as a marketplace facilitator where third-party sellers are involved. The responsibility for product quality, authenticity, warranties, and statutory compliance shall remain with the respective seller unless Garage88 is explicitly identified as the seller of record.

DELIVERY TIMELINES AND REVERSE LOGISTICS

Garage88 shall provide estimated delivery timelines at the time of checkout. Delivery timelines may vary depending on location, courier partner availability, and external circumstances. In case of eligible returns, Garage88 shall arrange reverse pickup through its logistics partners, subject to product verification and compliance with the return conditions.

REFUND MODE AND COD RULES

Refunds shall be processed only to the original payment source. For Cash-on-Delivery (COD) orders, refunds shall be processed via bank transfer or UPI to the account details provided by the User. Certain categories of products may be marked as non-returnable or non-refundable, and such exclusions shall be clearly disclosed on the product listing page.

CONSUMER FORUM RIGHTS CARVE-OUT

Nothing contained in these Terms shall restrict or limit the rights of consumers under the Consumer Protection Act, 2019, including the right to approach appropriate consumer courts or authorities for dispute resolution.

ENFORCEABLE LIMITATION OF LIABILITY WORDING

Garage88 acts solely as a technology platform facilitating connections between Users and independent Franchisees/ Service Partners. While Garage88 provides coordination support, the Franchisee remains solely responsible for service delivery, workmanship, vehicle safety, and consumer claims. Garage88's liability, where applicable, shall be limited strictly to the amount paid directly to Garage88 for booking or ecommerce facilitation services.

STATUTORY PLATFORM DISCLOSURES & GRIEVANCE OFFICER AND CUSTOMER SUPPORT

In accordance with applicable laws, Garage88 provides the following disclosures: Garage88 has appointed a Grievance Officer in accordance with the Consumer Protection (E-Commerce) Rules, 2020. LIMITATION OF LIABILITY

Garage 88 Private Limited (\"Garage 88\") acts solely as a technology-based service aggregator and booking platform that enables users to connect with independent mechanics, garages, franchise partners, service providers, technicians, and third-party vendors (\"Service Partners\").

Garage 88 does not own, operate, manage, or control any garage, workshop, mechanic, technician, or service facility. Garage 88 does not directly perform vehicle repairs, diagnostics, servicing, maintenance, modification, or any mechanical or technical work.

Accordingly Garage 88 is not responsible for the acts, errors, omissions, conduct, negligence, damages, delays, or service failures of Service Partners. Garage 88 does not provide warranties or guarantees regarding workmanship, spare parts, diagnosis accuracy, timelines, pricing, or service quality. Any disputes relating to service quality, part defects, damages, delays, or technician behavior shall be resolved directly between the User and the Service Partner. Garage 88 will assist in coordination but bears no liability for service outcomes.

Users acknowledge that all vehicle-related work is undertaken solely at their own risk with the selected Service Partner. Garage 88 does not warrant that the results that are obtained from the use of the Service will be accurate or reliable.

You agree that except as expressly stated by Garage 88, the Services and all the products provided/delivered to you through the Service are provided 'as is' and 'as available for your use, and are without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties. While we endeavour to ensure your access and use of the Platform is safe, we cannot and do not represent and warrant that the Platform or its server will be error-free, uninterrupted, free from unauthorized access, and/or otherwise meet your requirements.

In no case Garage 88 directors, employees, affiliates, franchisee, agents, contractors, interns, suppliers, service providers or licensors, liable for indirect, incidental, special, exemplary, punitive or consequential damages, including lost profits, lost data, personal injury or property damage related to, in connection with, or otherwise resulting from any use of the Services.

Garage 88 shall not be liable for any damages, liability or losses arising out of your use of or reliance on the Services or your inability to access or use the Services; or any transaction or relationship between you and any third-party provider or any delay or failure in performance resulting from causes beyond Company's reasonable control.

EXEMPTIONS TO LIABILITY OF COMPANY

User further agrees and confirms that the Garage88 directors, employees shall not be responsible, in any manner whatsoever, for any delay/unavailability of Services or failure to meet its obligations under the Terms and Conditions, which may be caused, directly or indirectly, due to: your failure to cooperate; your unavailability and/or unresponsiveness; your failure to provide accurate and complete information; your failure to provide or facilitate the submission of User materials in a timely manner; or any event beyond Garage 88's reasonable control.

User further agrees that the Garage88 directors, employees shall not be responsible, in any manner whatsoever, for any kind of service or spare part related issues of their affiliates, franchisee, agents, contractors, interns, suppliers, service providers or licensors nor from damage to User Vehicle or Vehicle Part or any kind of other (Vehicle or spare parts or any kind of accessories) or accident of the vehicles during pickup and drop or while in the premises of the franchisee partners or agents. However Garage88 shall provide all requisite assistance in a timely manner and/or any other formal steps as may be required but shall not be liable to compensate the User for its any type of loss.

CONSEQUENCES OF BREACH & INDEMNIFICATION:

In the event of a breach of the Policy, User shall be liable to pay liquidated damages along with costs of recovery of the damages to Garage 88. User shall be further liable to compensate Garage 88 for the losses incurred by Garage 88 due to the breach of Policy by you.

Garage 88 shall be entitled to immediately suspend/terminate the Services being provided to user if any of the terms of the Policy/agreement is breached.

User agree to defend, indemnify and hold harmless Garage 88, its officers, directors, employees, franchisee and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from breach of any of the terms of the Policy.

In no event shall Garage 88, its officers, directors, employees, partners, franchisee or agents be liable to you or any third party for any special, incidental, indirect, consequential or punitive damages whatsoever, including those resulting from loss of use, data, delay or profits or any other claim arising out, of or in connection with, your use of, or access to the Platform.

TERMINATION

Garage 88 may terminate your usage of the Platform or any Service at any time for any reason, including breach of any of the Terms and Conditions. Garage 88 has the right (but not the obligation) to refuse to grant access to the Platform.

Except for the rights and licenses granted in these Terms, we reserve all other rights and grant no other rights or licenses, implied or otherwise.

Once temporarily suspended, indefinitely suspended or terminated, you may not continue to use the Platform under the same account, a different account or re-register under a new account. On termination of an account due to the reasons mentioned herein, such User shall no longer have access to data, messages and other material kept on the Platform by such User.

You may terminate these terms at any time, for any reason
